TAPP will be referred to as "the company" "we" or "us". TRUCKAPP868 LIMITED will be referred to as "PARENT COMPANY". We are completely committed to ensuring at all times that your privacy and the privacy of friends and family accompanying you while using our services are protected. This privacy policy explains the types of Information collected by the company; how it is processed; how it is being used and how it is stored.

This Policy applies to all of the company's stakeholders who uses our application, website, social media, features or other services.

1. Definition and Meaning

CUSTOMERS: Customers are the end users who can place the request for taxi via the platform. Customers may also
be referred to as RIDER, or PASSENGER. A RIDER OR PASSENGER can also be a guest on someone's account.

DRIVERS: Drivers are the freelancers who will receive the request and will perform the transportation services accordingly. They collect the cash if the customers don't payment via an online system.

ACCOUNT OWNER: someone who submitted all necessary documents and was approved to use the services.

USERS: Both Drivers and Customers.

APP: The Technological Platforms downloaded by Drivers and Riders to a mobile device.

PROFILE: Is the outline of the users, both Driver's and Rider's  Personal information, this includes, Name, face photo, contact information, ride history and email.

RIDE: A request in motion. Another name for this is "trip"

SERVICES: The options of on-demand transportation provided by our Freelancers/ Drivers. Facilities available for purchase via the a;'pplication.

SUPPORT: In house assistance team.

SERVICE AREA: Is the geographical district in which the application operates which is Trinidad and Tobago 🇹🇹

TAPP is the data controller for the users in its Territory.

Base on the services that you use and your app settings or device permissions, the company may collect as accurate as possible a location via data such as GPS coordinates an IP addresses. It's is possible to use the application without enabling the company to collect your location, however this will affect the functions on your app and you will have to manually enter pickup locations. When you request a ride Driver's automatically sees the pickup and drop off locations you entered. However only the driver that accepts your request will be able to contact you and navigate exactly to where you are.

5. HOW WE USE YOUR DATA
The company does not sell, barter, or share your information  to third-parties for marketing purposes.

We use your data to assist in managing your SAFETY AND SECURITY; monitor the conditions thus managing the risk on rides.

We use your data for USERS SUPPORT; assistance by TAPP in house team.

We use your information for RESEARCH AND DEVELOPMENT of the application and services provide to better your experience

We use your information for better COMMUNICATION between users

We use your information for SETTLEMENTS investigations, claims, disputes or requested by law.

6.  COOKIES AND THIRD-PARTY TECHNOLOGIES
TAPP and its Partners use cookies and other identification technologies in our apps, website, emails and online ads.

1. Authentication of users
2. Remembering users references and settings
3. Understanding online behaviors of people who interact with our services.

7. INFORMATION SHARING AND DISCLOSURE
As required, we may share some of the information you registered and agreed to share in order for you to secure a ride request or other services provided by TAPP.


Customer's Information Shared to Drivers
A. Pickup and Drop-off locations will be displayed when ride request is sent out to multiple drivers along Ratings and number of rides previously taken.
B. Name (Prefix & Surname only) will be shared with the driver who accepts the trip only, along with a tab to go at your direct pickup location using "flight maps",  a tab with your contact number will also be on the screen for the driver to make contact with you. The driver will also be able to message the customer via the application for free and a tap with your drop-off location after the ride is started is also available to the driver.


Drivers  Information Shared With Customers
A. Once a driver is online, Customers requesting a driver will be able to see that Driver's location and estimated time of arrival (ETA).
B. Once a driver accepts a request, the customer is then able to see additional Information such as, Driver's name, mobile number, rating, face photo, vehicle make, model, color, vehicle photo and license plate. The customer will also be able to message the driver via the application for free.

We will share trip Information about an account with it's owner once requested by the owner of the account, including location and time. This occurs, for example when:
A rider uses another person's Account (arranged by the account's owner)

We Share data with our subsidiaries and affiliates ( logistics providers) to help us provide our services or conduct promotions or notices on our behalf.

We also provide data to service providers. These are for
A. Payment processors and facilitators
B. Background check and identify verification providers
C. Cloud storage
D. Google, in connection with use of Google Console
E. Facebook (see Facebook privacy policies for information on their collection and use of data)
F. Vendors that assist in security of apps
G. Accountants and financial partners (banks)
H. Third-party vehicle supplier

TAPP MAY SHARE A USER DATA OTHER THAN AS DESCRIBED IN THIS NOTICE IF WE NOTIFY THE USER AND THEY CONSENT TO THE SHARING.
WE MAY SHARE USERS' PERSONAL DATA IF EE BELIEVE IT REQUIRED BY APPLICABLE LAW, REGULATION, OPERATING LICENSE OR AGREEMENT LEGAL PROCESS OR GOVERNMENTAL REQUEST, OR WHERE THE DISCLOSURE IS OTHERWISE APPROPRIATE DUE TO SAFETY OR SIMILAR CONCERNS.

8. DATA RETENTION AND DELETION
Users may request deletion of their account at anytime. TAPP may retain user data after a deletion request due to legal or regulatory requirements or for reasons stated in this policy. We may also retain your information due to safety, security, fraud prevention, disputes, unresolved claims, or outstanding credit.

We don’t share any type of location data or customer information for any additional resources. we ensure to the customer for safe and accurate delivery with privacy taking under an authorization is appropriately secure and under the law of google consents.

ACCESS_BACKGROUND_LOCATION 

Above the location background, permission is used for tracking on the user side. Location service is used under the privacy policy of Google Play Developer Program Policies. We don’t share any type of location data or customer information for any additional resources taking under an authorization is appropriately secure and under the law of google consents.

SMS permission is needed for one-time verification of the user's mobile number. When we log in to the application with the mobile number, we need OT for verifying the user identity. Images are required to verify the documents like id proof of the client.

Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data. 


When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

TERMS AND CONDITIONS

1. AGREEMENT

This is a legal agreement between you and TAPP and its Parent

company, TRUCKAPP868 LTD. I hereby certify that the above-

mentioned Company, was incorporated under the Companies Act,

1995 of Trinidad and Tobago. 


2. TERMS

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

The terms of use govern the access

or use by you, an individual, rider, passenger or customer which

are the end users who place the request for the taxi via the

platform in the Republic of Trinidad and Tobago.

Terms may be enhance to certain services, such as policies for

promotions or a pandemic. If this occurs, these supplemental terms

shall be deemed a part of the previous terms.

At anytime, TAPP or it's parent company may make minor changes

to the terms related to the services provided and this will be in

effect from the time and date stated. Once you continue to use or

access the service after such enhancement means you agree to

the new terms and conditions.

If there is an incident involving law enforcement and TAPP and its

parent company is asked or summon by law, we may provide the

necessary information or data needed to resolve the complaint or

incident.


3.SERVICES

Our services includes transportation provided by Freelancers,

owner of motor vehicles and persons working for owners of

motor vehicles via an application on iOS and Android devices,

Facebook and website. The Technology platform enables you to

arrange and schedule transportation using independent third-party

providers who deals with emails, sms messages, promotional

codes etc.


4.LICENSE

In essence to you complying with the wishes of these terms, we at

TAPP surely permit you a bounded, non-exclusive, revocable, non-

transferable (non-sub licensable) license to

A. Open and utilize the application in connection with your use of

the services only

B. Open and utilize any functions that maybe installed into the

application but only for authorized and legal uses only. According

to the laws of Trinidad and Tobago.

At anytime TAPP and its licensor may review these rights.

RESTRICTIONS

You simply CANNOT

1. Interfere with any copyright, trademark or anything related to an

owner or ownership of the service, this includes memes, ad ons or

minus.

2. Reproduce, sell, resell, transfer, share, stream, broadcast,

publicly display, transmit, prepare derivative works base upon or

otherwise exploit the services except as expressly permitted in

writing by TAPP.

3. Reverse engineer (produce source code from compiled code).

4. Link this service with another.


5. Be involve in data mining any portion of the service, hindering

the operation of the services.

6. Attempt to gain unauthorized access to or impair any aspect of

the services or it's related systems or networks.

7. Contact our stakeholders without our permission unless via ride

request. Not apply to contacting support team.


5. PROVISION OF THE SERVICES

You acknowledge and understand that the services provided by

TAPP comes in alternative ways and request options associated

with the vehicle type, make, model, reasons, functions, seating

capacity and location from third-party logistics providers available

via the Rideshare application. THESE SERVICES MUST NOT BE

MISUNDERSTOOD WITH OTHER SERVICES TAPP PARENT

COMPANY PROVIDES.


6. THIRD-PARTY SERVICES AND CONTENT

Other businesses, organizations and establishments may use our

services to provide services to their clients, in advertising or

promotions that TAPP does not control. Please understand that

those businesses, organizations and establishments may have

different terms and conditions apply to their content which TAPP

may not endorse. TAPP, iT's parent company and logistics

providers shall not be responsible or liable for any products or

services of such third-party providers.


7. OWNERSHIP

Our terms, your period of use or affiliation to TAPP does not

transfer or permit you any rights to the following


A. Own (especially by law) any of its services or assets.

B. To use or reference in any manner TAPP, its parent company or

licensor names, trademark, logos, products and services names.

i.g. social media sites ( including whatsApp) memes. THE SEVICES AND ALL RIGHTS THEREIN ARE AND SHALL REMAIN TAPP'S AND TRUCKAPP 868 LIMITED PROPERTY OR THE PROPERTY OF OUR LICENSORS.


8. PAYMENT

You fully understand and acknowledge that the use of services to

you are not free and will result in charges to you for time and

distance traveled while you are in the vehicle, waiting time,

luggage and / or other functions from third party logistics providers

available through the services. Car park fees will need to be paid

by you separately, to the car park operator. All charges are due

immediately after final destination and payment should be facilitate

by the rider or previously by the account's owner before confirming

the ride request via one of the payment options available. A receipt

will be sent to your email address that you provided at sign up. In

addition You acknowledge and agree that charges applicable in

certain geographical areas may or may not increase during times

of high demand. We will inform you before this occurs. The

account holder will be responsible for all charges. Tipping is

"voluntary" not "required". After a ride is completed, you will be

able to rate and comment on services received.


9. DISCLAIMERS

The services are provided "As Is" and "as available" TAPP

and its parent company make no representation, warranty, or

guarantee regarding the reliability, timeliness, quality, suitability or

availability of the services through the use of the application or that

the services will be uninterrupted or error-free. TAPP does not

guarantee the safety or ability of third party providers. You agree

that the entire risk arising out of you use of the services and any

services or good requested in connection there with remains solely

with you, to the maximum extend permitted under applicable law.


10. LIMITATION OF LIABILITY

TAPP and its parents company shall not be liable for indirect,

incidental, special, exemplary, punitive or consequential damages,

including lost profits, lost data, personal injury or property damage

related to, in connection with or otherwise resulting from any use of

the services, even if TAPP has been advise of the possibility of

such damages. TAPP shall not be liable for any damages, liability

or losses arising out of.

1. Your use of or reliance on the services or your inability to access

or use the services, or

2. Any transaction or relationship between you and any third-party

provider, even if TAPP has been advise of the possibility of such

damages. TAPP shall not be liable for delay or failure in

performance resulting from causes beyond our control.

The above does not purport to limit liability or after you rights as a

consumer that cannot be excluded under applicable law.


11. REPAIR AND CLEANING FEES.

As a passenger, you may be responsible for the cost of any

damages or spillage caused by you on a ride if see fin by triple

and tear of a drivers vehicles.


12. INDEMINITY.

you agree to indemnify and hold TAPP and its officers, directors,

employees, agent, recent company, third party provides harmless

from any and all claims, Demands, losses. Liabilities and expenses

(including attorney's fees) arising out of or in connection with

1. Your use of the general application

2. Your breach or violation of any of these terms.

3. TAPP'S use of your user contract

4. Your violation of the rights of any third-party, including third-party

providers.


13. GOVERNING LAWS, ARBITRATION.

Excepts as otherwise set forth in these terms, these terms shall be

exclusively governed by And construed in accordance with the

laws of Trinidad and Tobago.


14. PROMOTION CODES

From time to time TAPP may create "promo codes" that may be

redeemed for account credit. We may create "promo codes" to

show appreciation or any other benefits to stakeholders. You

agree that


1. Prom codes be used by intended audience and for intended

purposes.


2. May not complicated , sold, transfer or barter in any manner or

made available to any other person or general public unless stated

by TAPP.


3. May be disable by TAPP, its parent company or logistic

providers at any time with out liability to Us.


4. May only be used for particular reason established for promo

code.


5. Are not valid for cash or with transfer.


6. May expire prior to you use if the use of promo codes are found

in violation, TAPP reserves the right to withhold or decline credits

and block users from future promo codes.


15. NETWORK ACCESS AND SERVICES.


You are solely responsible for obtaining the data network and

necessary to use the services. The service may be subject to

malfunctions and delay inherent in the use of the internet wifi and

electronic communication.


16. SERVICES USE.

You are responsible for activities that occurs under your account ,

message, ride request, cancelations, with ours during a ride that

was requested on your account, payment, ratings and comments

even it you phone was stolen. Account's must be maintain by

users, anyone with a phone number is registered to or a Facebook

account can basically own a TAPP personal user account. If you

are under 18 years of the your owners ship needs to be backed up

by a guardian (personal information may be required) name,

address, phone number, email, age, usual pick up and drop of

destination, emergency contacts. Accurate, complete and up

to date information must be presented for all accounts its failure or

having accurate information on your account including photos may

result in your inability to access and use the services or TAPP.

Since you are solely responsible for you account it is advisable

secure passwords, accounts usernames etc. To the device your

account is on and your account itself. As a passenger you may

only be permitted to have one account.


17. USERS REQUIREMENTS AND CONDUCT.

You may not authorize third parties to use you account unless a

child under the age of 18 is with them. Account's are not

transferable, Name changed can only occur if someone is

married or legally changed their names (supporting documents

required ) you must agree to comply with all applicable laws when

using TAPP and you must only use the services for law full

purpose, Unlawful or hazardous materials will not be allowed,

inconvenience or property damage to third-party provider or any

other party including yourself. In some instances you may be

asked to provide. Proof of identify to access or use the services.

And you agree that you may be denied access to or use of the

services if you refuse to provide proof of identify.


18. CONTACTING.

By providing constant information you agree that TAPP may send

text(sms) messages, emails, whatsApp messages or a phone calls

as part of the normal business operations.

You may indicate contact time to our team or refuse to reply

although you may miss important and vital information.

These terms shall not be transferred in whole or in part without TAPP's written approval.

The company may at anytime for any reason forthwith terminate, withhold, withdraw or deny access to these terms or services or any part thereof to you.

The company's failure to enforce any rights or provision in these terms shall not constitute a waiver of such rights or provision unless acknowledged and agreed to by us in writing.
